Medicare Set-Aside (MSA)

A Medicare Set-Aside is a portion of your injury settlement that is reserved to pay for future medical expenses related to your injury. Medicare requires this so that your settlement money — not Medicare — covers injury-related medical costs first. Once the MSA funds are properly exhausted, Medicare resumes paying for those medical expenses.

It depends on your situation. If you are currently a Medicare beneficiary, or if you are reasonably expected to become one within 30 months of your settlement, you may need to consider Medicare's interests. Medicare Liens

A Medicare lien is a claim that Medicare has against your settlement for medical treatment it paid for during your case. When Medicare pays for treatment related to your injury while your claim is pending, it has the right to be reimbursed from your settlement. The total of these payments is the lien amount.

Yes. Medicare allows for reductions based on procurement costs (your attorney fees and legal expenses). Additionally, if the lien includes charges for treatment unrelated to your injury, those can be disputed and removed. Medvst reviews every charge and negotiates with Medicare to reduce your lien to the lowest legitimate amount.

The timeline varies depending on the complexity of the lien and how quickly Medicare and the BCRC respond. Typically, the process takes 30 to 90 days from the time we receive all necessary documentation. We work to resolve liens as quickly as possible so your settlement can be finalized without unnecessary delays.
